Last week entities associated with “Cotton Campaign” filed a petition alleging that entities such as Ikea sell products from Turkmenistan that are made through use of forced labor. The complaint is based on CBP regulation under 19 C.F.R. § 12.42, stating in relevant part: (b) Any person outside the Customs Service who has reason to believe that merchandise produced * * * is likely to be, imported into the United States and, if the production is with the use of forced labor * * * that merchandise of the same class is being produced in the United States in such quantities as to meet the consumptive demands of the United States may communicate his belief to any port director or the Commissioner of Customs. Every such communication shall contain, or be accompanied by, (1) a full statement of the reasons for the belief, (2) a detailed description or sample of the merchandise, and (3) all pertinent facts obtainable as to the production of the merchandise abroad. If the foreign merchandise is believed to be mined, produced, or manufactured with the use of forced labor or indentured labor under penal sanctions, such communication shall also contain (4) detailed information as to the…

H.R.644 – Trade Facilitation and Trade Enforcement Act of 2015

Yesterday, Mr. Obama approved law affecting trade generally, and customs law particularly.  The Act is available at this link: https://www.congress.gov/bill/114th-congress/house-bill/644/text The law will affect informal entries under 19 U.S.C. 1321 raising the ceiling to $800.  The law now specifically prohibits licensed customs brokers to engage in terrorist activities.  HTSUS subheadings 9802.00.40 and 9802.00.50 may be commingled with fungible articles.  Certain drawback provisions have been revised.  HTSUS provisions for apparel in Chapter 62, footwear in Chapter 64 incurred revisions.  Manhole rings renamed to castings.  And Nepal received further preferential treatment on some products… among other things.

CBP Gives a Green Light To Extrajurisdictional Application of HTSUS Chapter Notes

Members of international trade community know that harmonized tariff schedule is construed according to the principles of General Rules of Interpretation (GRIs).  GRI 1 states that “classification shall be determined according to the terms of the headings and any relative section or chapter notes.” (emphasis supplied).  In recent Customs Bulletin, CBP decided to apply “relative” requirement loosely.  The departure from “relative” requirement under GRI 1 took place in the context of reclassification of polyurethane coated gloves.  Specifically, CBP attempted to reconcile the differences between gloves provided under Chapter 39 and Chapter 61: 3926.20.10 provides for “other articles of plastics …: … clothing accessories (including gloves …): … gloves: … 6116.10.55 provides for “gloves … knitted or crocheted: Impregnated, coated or covered with plastics … Finding that “terms of the heading” do not provide adequate explanation, CBP turned to other legally binding instrument under GRI 1: section and chapter notes.  CBP turned to Legal Note 1 to Section XI (the Section for Chapter 61) and Note 2 to Chapter 39.  This was a legitimate inquiry because these section and chapter notes are all relative to the headings that were analyzed.  But, CBP came across difficulty in reconciling these provisions because one…

Importer Requirements under Flammable Fabrics Act

Under the Flammable Fabrics Act, CPSC can issue mandatory flammability standards. Standards have been established for the flammability of clothing textiles, vinyl plastic film (used in clothing), carpets and rugs, children’s sleepwear and mattresses and mattress pads. The importer, at the time of importation, executes and furnishes to the U.S. Customs and Border Protection an affidavit stating: These fabrics (or articles of wearing apparel) are dangerously flammable under the provisions of section 4 of the Act, and will not be sold or used in their present condition but will be processed or finished by the undersigned or by a duly authorized agent so as to render them not so highly flammable under the provisions of section 4 of the Flammable Fabrics Act, as to be dangerously flammable when worn by individuals. The importer agrees to maintain the records required by 16 CFR 1610.39(c)(1). Textile Classes: Class 1 textiles, those that exhibit normal flammability, are acceptable for use in clothing. §1610.4(a)(1) & (2). Class 2 textiles, applicable only to raised-fiber surfaces, are considered to be of intermediate flammability, but may be used in clothing. §1610.4(b)(1) & (2). CBP “updates” to its website that came this August do not bring much new. There is still work to be done for “Other Agencies” section, for example, that does not list upland cotton program administered by USDA’s AMS Cotton Division. Of some value, one may find CBP contact information with respect to quotas (202-863-6560; hq.quota@dhs.gov). Tariff Schedule, it seems, remains the most reliable guidance for quota applications.
